No 5th Amendment Rights in Scottsdale either

  I think in this case the police will lie and say that incidents like this rarely happen and that the police always honor a suspects 5th Amendment right to remain silent.

I will say that is a blatant lie, and the police routine flush any suspects right to remain silent down the toilet! I say this from experience. Each and every time I have a contact with the police I always state up front that I am taking the 5th and refusing to answer any police questions, including telling them my name.

Each and every time this happens the police lie to me and tell me I don’t have any 5th Amendment rights and that I must answer their questions. Just like the police at MCC did when they falsely arrested me for two hours.

In addition to telling me I don’t have any 5th Amendment right the police almost always lie and tell me that if I don’t answer their questions I will be arrested and charged with some crime for refusing to talk.

This isn’t an isolated incident it routinely happens every time I am stopped by the police and tell them I am taking the 5th.

In this case the police at MCC, and the Mesa city police lied and told me I didn’t have any 5th Amendment rights.

Three times I have been falsely arrested by the Tempe police and told I didn’t have any 5th Amendment rights.

Once I was falsely arrested by the Maricopa County Sheriff and told I didn’t have any 5th Amendment rights, they quickly released me when I accidentally told them I had filed a lawsuit in Federal Court suing the Tempe Police for the same thing.

Twice I was falsely arrested by the ASU police, again they told me the same thing, I don’t have 5th Amendment rights on the ASU campus.

Twice I was falsely arrested by the Phoenix police, who told me, I don’t have 5th Amendment rights in the City of Phoenix.

Once I was falsely arrested by the Arizona DPS, who also told me, I don’t have 5th Amendment rights when being questioned by the state DPS police thugs.

In NONE of these cases was I charged with any crimes. In each case I was usually falsely arrested for about an hour and then release when the police realized they would not be able to find any of the “probable cause” they needed to charge me with a crime. During each arrest the police involved continually illegally threatened me and demanded that I tell them my name or I would receive some type of severe punishment.

Sex counts against ex-teacher dismissed

A Maricopa County Superior Court judge has dismissed the sexual-abuse case against a former Saguaro High School teacher, allowing prosecutors time to appeal a decision to throw out his confessions.

The case against Tom Porras, a former professional football player, could be refiled.

A dismissal is automatic when prosecutors appeal a judge's ruling, said Barnett Lotstein, special assistant to Maricopa County Attorney Andrew Thomas. Prosecutors have confidence in their case even if the appellate court doesn't reinstate Porras' confessions.

The County Attorney's Office disagreed with Judge Helene Abrams' decision in January to toss the confessions of Porras, accused of luring a 17-year-old female student to his home for an "athletic massage."

In her three-page ruling, Abrams agreed with Amy Nguyen, Porras' attorney, saying Scottsdale police at the school advised Porras of his Miranda rights to remain silent and have an attorney present during questioning.

Abrams said Scottsdale police violated Porras' Miranda rights when they pressured him to talk about the case after he told them he did not want to make any statements.

Lotstein said that "there were no constitutional violations of the defendant's rights," as Porras continued to answer detectives' questions.

Porras was charged with felony sexual abuse and misdemeanor counts of public sexual indecency and assault.
